A company utilizes a trademark to classify its services or products from all of those similar items and/or services of another company. The proprietor of a registered trademark has the right to use “®” at the end of their registered mark, Under the Trade Marks Act 1999. The trademark cannot be registered if abusive, undifferentiated, and containing government emblems are identified.
As per section 25 in the Trade Marks Act, 1999 a registered trademark is valid for 10 years, and it can be retained online with required renewal fees every ten years by filing a renewal application. The request must be submitted before 6 months of the date the registration expires as per rules 63 and 64 in Trade Mark rules, 2002. Trademark Renewal in India will help you retain your trademark permanently and you have little to do with how many years you would like to keep your trademark status active, and how many years you want to preserve it. If somehow the trademark has expired it can still be renewed by making an application within six months of the expiration.
Six months prior, the owner is informed about the date for the renewal of the trademark, the office of the registrar sends a notice. The trademark is removed from the Trademark Registry upon non-renewal of the trademark within the specified period.
However, by applying along with the appropriate fee, the trademark may also be restored.
- Continuation of Ownership
Protection from infringement of rights over the trademark may be used. The trademark’s exclusive rights will be renewed 10 years after any application. It also offers permanent security for your brand and your brand reputation. - Legal Defence against Law Suits
Seamless defence of trademarks is possible without a dispute. Trademark renewal makes it difficult for anyone other than the holders of the trademark to claim ownership.
